LATAH COUNTY, Idaho -- Prosecutors took new steps to secure more evidence from Bryan Kohberger's defense team Tuesday.
Kohberger is accused of killing Kaylee Goncalves, Madison Mogen, Xana Kernodle and Ethan Chapin in a shared, off-campus house near the University of Idaho on November 22, 2022. Kohberger was fired from his teaching position in criminology at Washington State University (WSU) days before the murders happened.
In a request for discovery disclosure and alibi demand, the State of Idaho asked for all books, papers, documents, photographs, and tangible objects the defense plans to introduce in evidence at trial.
Latah County Prosecutor Bill Thompson also requested all results or reports of physical or mental examinations; of scientific tests or experiments made in connection with the quadruple murder case, or which were prepared by a witness the defense intends to call as a witness at the trial: these are known as expert witnesses, who often give expert opinions at trials.
Thompson requested the names of all witnesses Kohberger's team will call at trial.
The prosecution also wants to know if Kohberger intends to use an alibi as part of his defense (Idaho Code 19-519). If both parties agree, a court-appointed mediator can help reach agreements on conditions like sentencing options, restitution, and what evidence will go to trial (Idaho Criminal Rule 12.1).
The Prosecution has until the end of June to disclose whether it intends to seek the death penalty against Kohberger.
