9-year-old boy charged with assault with a deadly weapon

A 9-year-old boy has been charged with assault with a deadly weapon and using racial slurs against the woman who called him out on his bad behavior.

The elementary school student is behind bars, but it’s not clear if he’s even going to be prosecuted.

That’s because Washington State law says when our children are between the ages of 8 and 12, they are presumed to be incapable of committing crime.

However, there are exceptions to that restriction and this boy may still qualify for prosecution.

We’re not going to reveal his name or face, but this 4 and a half foot tall, 90 pound kid has been terrorizing neighborhoods just north of North Town Mall.

Police say Friday night the 9-year-old walked by the victim’s apartment and started yelling at her.

When the African American woman told the boy to leave and stay away from her kids, the suspect cussed at her, including using a racial slur.

He then allegedly pulled a box cutter on the woman and moved in to slash her when the victim’s nephew intervened and disarmed the 9-year-old.

Police have had problems with this kid before.

They knew where he lived, went to his house, and arrested him.

Monday in court, the boy was charged with second-degree assault with a deadly weapon, which reportedly was his third felony.

On the advice of his attorney, the boy agreed to be detained.

During a future hearing, probation officers and mental health experts will offer testimony about whether or not this 9-year-old should be prosecuted as a juvenile.

And until that hearing gets underway, this young defendant will get counseling and mental

evaluations.

His previous alleged crimes have included robbery.
