For the second time a Whitman Country jury has failed to reach a verdict in the case of a Spokane man charged with helping his brother murder a Rosalia man.

The 12-member jury failed to reach a verdict Monday against Daniel Lazcano, who is on trial for kidnapping and first degree murder.

Lazcano was charged, along with his brother Frank, in connection with the shooting of 23-year-old Marcus Schur in a Malden home in December of 2010 and disposing of the body in Bonnie Lake.

Frank Lazcano was convicted of Schur's muder in March and was sentenced to 25 years in prison.

Whitman County Prosecutor Denis Tracy, reacting to Monday's decision, said he is disappointed but respects the jury's decision.

Tracy said he has 90 days to determine if he will proceed with a third trial but has yet to decision on what, if any, course of action he may take.
