A man who hit a 74-year-old woman with a skateboard in Pendleton pleaded guilty Monday to assault and avoided prison.
Justin Troy Doss has no prior serious felony convictions and reached a plea agreement with the Umatilla County district attorney's office. The East Oregonian reports the 23-year-old could have been sentenced to nearly six years in prison. Instead, he was given five years of probation and ordered to apologize to Nancy Ashworth.
The two clashed last October near a skate park where Ashworth was walking her dog. Doss was there with his unleashed dog, which threatened Ashworth. She sprayed his dog with pepper spray. Doss struck her with his skateboard. The attack ended when she pulled out a .38-caliber revolver and fired a shot in the air.
