A 21-year-old man who acted as a lookout while three others beat a convenience store clerk with baseball bats and took the cash register has avoided prison time.
The Missoulian reports District Judge Karen Townsend gave Cruz Bernardi a five-year suspended prison sentence Tuesday. Bernardi pleaded guilty in June to conspiracy to commit robbery, saying he acted as a lookout provided the baseball bats.
Bernardi was one of five men charged after the Jan. 8 robbery at Jay's Mart. The men used the money to help pay their rent.
Deputy Missoula County Attorney Jason Marks said he expected a lighter sentence because Bernardi cooperated with the investigation.
One co-defendant was sentenced to 10 years in prison.
