SPOKANE, Wash. - A judge declared a mistrial in the case against former Spokane police Sgt. Gordon Ennis on Monday.
Ennis is facing a second-degree rape charge in connection with an alleged sexual assault that happened at a party hosted by Spokane officer Doug Strosahl in October 2015.
Attorneys called in an extra large pool of 120 potential jurors due to the high profile nature of the case, but according to Ennis's attorney Rob Cossey, it wasn't enough. Cossey told KXLY that a judge decided they couldn't seat a jury who didn't already know details of the case.
A female officer, who knew Ennis, said she passed out in a guest bedroom after having several drinks and woke up to Ennis sitting next to her with his hand down her pants, fondling her.
Cossey said they're working to set a new trial date and believes the trial will still be held in Spokane.
