Man convicted of making Ricin appealing conviction

A Spokane man convicted in 2003 of attempting to make a deadly poison has filed an appeal of his conviction on a battery of claims ranging from ineffective counsel to prosecutorial misconduct.

Kenneth Olsen was convicted in 2003 of making Ricin and sentenced to 10 years in federal prison.

Attorneys for Olsen are now asking that his conviction be overturned citing a range of problems with his case including prosecutorial misconduct, the prosecution's failure to provide discovery, witness tampering and ineffective counsel.

The government now has 30 days to respond to the motion and a hearing on Olsen's appeal has been set for January 29, 2010 in U.S. District Court.
